General Terms and Conditions of Sale (GTCS)

Updated October 2, 2026

Article 1 - Purpose and Scope

These general terms and conditions of sale (GTCs) govern distance sales of products concluded on the atelierdupouf.com website between ATELIER DU POUF and any individual acting for purposes outside their commercial, industrial, craft, professional, or agricultural activity (the "customer"). The GTCs are available on the site at all times; placing an order implies acceptance of the version in force on the date of the order.

Article 2 - Seller's Identity

ATELIER DU POUF
Simplified joint-stock company with share capital of €5,000
Registered office: 7 rue des Omnibus, 59200 Tourcoing, France

Article 3 - Products

The products offered for sale are those presented on the site, together with their essential characteristics (dimensions, materials, colors, and delivery times). The photographs are as accurate as possible; slight variations in color may occur depending on the screen used.

The IVORIA, AURORE, SYLVA and LUNA models make up Atelier du Pouf's Signature collection: they are based on our own designs. The other products offered on the site come from third-party suppliers; they are selected and marketed by ATELIER DU POUF but are not our own designs. Regardless of their origin, all products are sold by ATELIER DU POUF, which remains the customer's sole point of contact and is liable to the customer for the statutory warranties.

Offers are valid while stocks last. If a product becomes unavailable after the order is placed, the customer will be informed as soon as possible and refunded no later than fourteen days after payment of the sums paid.

Article 4 - Prices

Prices are shown in euros, including all taxes (French VAT included). The applicable price is the one displayed when the order is confirmed. Any delivery charges are shown before the order is confirmed; as of the date hereof, standard delivery is free to all destinations offered on the site. For deliveries outside the European Union (particularly to Switzerland), the customer may owe import duties and taxes to the relevant authorities or carrier.

Article 5 - Orders

The customer selects the products, reviews the contents of their basket, enters their contact details and delivery address, chooses a payment method, and then confirms their order. Before confirming, they can review the order details and total price and correct any errors. The order becomes final once payment has been confirmed; a confirmation email summarizing the order is then sent to the customer.

ATELIER DU POUF reserves the right to cancel any order placed by a customer with whom there is a dispute relating to payment for a previous order.

For any order amounting to €120 or more, ATELIER DU POUF retains the written document recording the contract for ten years from delivery and guarantees the customer access to it upon simple request to contact@atelierdupouf.com.

Article 6 - Payment

The price is payable when the order is placed, by bank card (Cartes Bancaires, Visa, Mastercard), PayPal or Bancontact, depending on the payment methods offered at checkout. Payments are processed securely by our payment service providers; ATELIER DU POUF does not have access to the complete bank card details.

Article 7 - Delivery

The products are delivered to the address indicated by the customer, in mainland France (including Corsica), Switzerland and the European Union countries offered at checkout.

Indicative delivery times in mainland France: 5 to 7 working days for the Signature collection (IVORIA, AURORE, SYLVA, LUNA) and 4 to 5 working weeks for other products. The applicable timeframe is indicated on each product page and at checkout. Detailed information is provided in our shipping policy.

If the indicated delivery date or period is exceeded, the customer may, after formally requesting ATELIER DU POUF to make the delivery within a reasonable additional period, terminate the contract by registered letter with acknowledgment of receipt or in writing on another durable medium if delivery has not taken place within that period (Articles L. 216-6 et seq. of the French Consumer Code). The amounts paid will then be refunded no later than fourteen days following termination.

The risk of loss of or damage to the products passes to the customer when they physically take possession of the products. Customers are advised to check the condition of the parcel upon delivery and report any irregularities (damaged parcel, missing product) to the carrier and customer service as soon as possible, if possible with photographs.

Article 8 - Right of withdrawal

In accordance with Articles L. 221-18 et seq. of the French Consumer Code, consumer customers have a period of fourteen (14) days from receipt of the goods to exercise their right of withdrawal, without having to give a reason for their decision or incur any costs other than those set out below. In the case of an order for several goods delivered separately, the period runs from receipt of the last item.

How do I withdraw? The customer must notify us of their decision before the deadline expires, using our withdrawal form (the “Withdrawal form” link at the bottom of each page), or by any unambiguous statement sent by email to contact@atelierdupouf.com or by post to the registered office. The statutory withdrawal form template appears on this same page. An acknowledgment of receipt will be sent by email.

Returning the products. The customer must return the products without undue delay and no later than fourteen days after communicating their decision, to the following address:
ATELIER DU POUF – Returns Department
220 Impasse Jacqueline Auriol
59118 Wambrechies, France

Return costs. The direct costs of returning the products are borne by the customer. Due to their volume, the beanbags cannot normally be returned by standard postal service and require a carrier: the return cost is estimated at up to €40 for a return from mainland France. For a return from another country, the customer may contact us before shipping for an estimate.

Condition of the products. The customer is liable only for any loss in value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and proper functioning. The original packaging is recommended when still available, or otherwise packaging offering equivalent protection; this is not a condition for exercising the right of withdrawal.

Refunds. ATELIER DU POUF will refund all amounts paid, including standard delivery costs, without undue delay and no later than fourteen days after the date on which it is informed of the decision to withdraw. The refund may be deferred until the goods have been recovered or until the customer has provided proof that they have been shipped, whichever is earlier. It will be made using the same means of payment as that used for the initial transaction, unless the customer has expressly agreed to another method. Additional costs resulting from the customer's express choice of a delivery method more expensive than standard delivery will not be refunded.

Exceptions. The right of withdrawal cannot be exercised for contracts referred to in Article L. 221-28 of the French Consumer Code, particularly the supply of goods made to the consumer's specifications or clearly personalized. The products offered on the site are standard models: their purchase gives the customer the right of withdrawal.

Article 9 – Legal guarantees

All products sold on the website benefit from the legal guarantee of conformity and the legal guarantee against hidden defects. To invoke them, the customer should contact customer service at contact@atelierdupouf.com by describing the defect, if possible with photographs. The cost of returning a non-conforming or defective product is borne by ATELIER DU POUF.

The consumer has two years from delivery of the product to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish the existence of the lack of conformity, not the date on which it appeared.

The legal guarantee of conformity entitles the consumer to have the product repaired or replaced within thirty days of their request, free of charge and without major inconvenience.

If the product is repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial warranty.

If the consumer requests repair of the product but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date the product is replaced.

The consumer may obtain a reduction in the purchase price while keeping the product or terminate the contract and receive a full refund upon returning the product, if:

  1. the professional refuses to repair or replace the product;
  2. repair or replacement of the product takes place after a period of thirty days;
  3. repair or replacement of the product causes a major inconvenience for the consumer, particularly when the consumer definitively bears the costs of taking back or removing the non-conforming product, or bears the installation costs of the repaired or replacement product;
  4. the lack of conformity persists despite the seller's unsuccessful attempt to bring the product into conformity.

The consumer is also entitled to a price reduction or to terminate the sales contract when the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. The consumer is then not required to request repair or replacement of the product first.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the product is unavailable for repair or replacement suspends the remaining warranty period until the refurbished product is delivered.

The rights referred to above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who, in bad faith, obstructs the implementation of the legal warranty of conformity is liable to a civil fine of up to €300,000, which may be increased to up to 10% of average annual turnover (Article L. 241-5 of the Consumer Code).

The consumer also benefits from the legal warranty for hidden defects under Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This warranty entitles them to a price reduction if the goods are retained or to a full refund in exchange for returning the goods.

Article 10 – Liability

ATELIER DU POUF shall not be held liable for failure to perform the contract attributable to the customer, an unforeseeable and insurmountable act by a third party to the contract, or force majeure. It shall not be liable for damage resulting from use of the products contrary to their intended purpose or to the care instructions provided.

Article 11 – Customer Service and Complaints

For any questions or complaints, customer service can be reached by email at contact@atelierdupouf.com or by post to the registered office.

Article 12 – Consumer Mediation

In the event of a dispute, the customer must first send a written complaint to customer service at contact@atelierdupouf.com. If no amicable solution can be reached, they may refer the matter free of charge to the consumer mediator appointed for ATELIER DU POUF within one year of submitting their written complaint:

CM2C – Centre for Consumer Mediation by Justice Conciliators
49 rue de Ponthieu, 75008 Paris
Website: www.cm2c.net

Article 13 – Personal Data

The personal data collected when placing an order are processed by ATELIER DU POUF in accordance with its privacy policy.

Article 14 – Intellectual Property

The texts, photographs, logos and other elements of the website are the property of ATELIER DU POUF or its partners. Any reproduction without authorization is prohibited.

Article 15 – Applicable Law and Disputes

These General Terms and Conditions of Sale are drafted in French and governed by French law. In the event of a dispute, and in the absence of an amicable settlement or mediation, the consumer may bring proceedings, at their choice, before the court of the place where they resided when the contract was concluded or when the damaging event occurred, or before any other competent court under the applicable legal rules. A consumer residing in another Member State of the European Union also benefits from the mandatory provisions of the law of their country of residence.

Article 16 – Amendment of the General Terms and Conditions of Sale

ATELIER DU POUF may modify these General Terms and Conditions of Sale at any time. The applicable General Terms and Conditions of Sale are those in force on the date of the order.
